Navigating ITAD and Regulatory Compliance Challenges 

As the digital world expands, so do the complexities of responsibly retiring its hardware. Navigating regulatory landscapes and compliance challenges is a key factor in maintaining a smooth disposition process. Recent changes in industry standards make compliance a little more difficult to achieve. 

One major regulatory obstacle is the recent changes to the Basel Convention. The Basel Convention on the Control of Transboundary Movements of Hazardous Waste and their Disposal is an international treaty that controls the management and trade of waste worldwide. In 2021, the Basel Convention published several proposed alterations to the convention itself that would dramatically change how some end-of-life exports are managed. 

The proposed Swiss-Ghana changes included reclassifying certain materials as hazardous and expanding the definition of “waste” under the convention to include devices being prepared for reuse. Both amendments create more paperwork and loopholes for companies to navigate to ship used devices to other countries and prevent e-scrap exports of certain materials to Basel party countries altogether. 

The changes were accepted in 2022, resulting in further e-scrap restrictions. The reclassification requires exporter notification and receipt of consent from authorities within the importing country. However, because the U.S. is not a party to the Basel Convention, all exports of devices covered under the convention from the U.S. to Basel-party countries will be considered illegal. This will largely disrupt the U.S. industry and change the competitive landscape for the U.S. on a global scale. 

Compliance is a growing focus area, and a key factor in maintaining certifications is compliance. As part of legislative compliance, certifications provide documentation to ensure clients that their equipment is in professional hands and accountability in the warehouse. Certifications in the ITAD industry present a challenge due to changes in industry standards, especially since the introduction of ESG reporting. 

Sustainable Electronics Recycling (SERI) released the first significant revision of the R2 practices since 2013 in 2020 as R2v3. As the highest quality standard certification in the sustainability space, R2v3 compliance can pave the way for achieving successful ESG criteria. The updated R2v3 certification includes tighter safety measures regarding data security and a more detailed description of services, such as a scope statement, process requirements, a list of other locations, etc.

SERI also has convened a technical advisory committee dedicated to developing a comprehensive ESG reporting standard within the ITAD industry, aiming to enhance transparency and sustainability in electronic waste management.
